Terms of Use and Sale

These general terms govern access to and use of the companyfrance.fr website and, where applicable, the subscription to the paid plans offered by Espero-Soft Informatiques.

1. Purpose

These Terms of Use and Sale (the “Terms”) define how the companyfrance.fr website (the “Service”) published by Espero-Soft Informatiques may be accessed and used, as well as the conditions applicable to any paid plans. Any use of the Service implies full acceptance of these Terms.

2. Definitions

In these Terms:

  • “Publisher”: the company Espero-Soft Informatiques.
  • “Service”: the site and features accessible at companyfrance.fr.
  • “User”: any person accessing the Service.
  • “Account”: the personal space created by the User.

3. Description of the service

The Service lets users search and consult public information on French companies (identity, legal form, activity NAF/APE, establishments, directors), based on the open SIRENE/INSEE and RNE/INPI data. Some features (favorites, history, alerts) require creating an account.

4. Access and account

Access to the core features is free. An account is created without a password, via a one-time code sent to your email address or via Google. You are responsible for the confidentiality of access to your inbox and for the use of your account.

5. Permitted use

The User undertakes to use the Service fairly and lawfully. The following are prohibited in particular:

  • Mass or automated extraction of data (scraping) outside the provided APIs and limits.
  • Resale or redistribution of data in breach of the Open Licence.
  • Any attempt to compromise the security or availability of the Service.
  • Use of the information for unlawful prospecting or purposes contrary to the GDPR.

6. Data from public sources

The data displayed comes from public registers and is reused under the Open Licence (Etalab). The Publisher is not affiliated with INSEE or INPI and does not guarantee the accuracy or completeness of the data. Natural persons have a right to object and to restrict dissemination (see Legal notice and Privacy policy).

7. Plans and subscriptions

Some advanced features may be offered as paid plans (subscriptions). The characteristics, scope and price of each plan are shown on the site at the time of subscription. Subscribing constitutes acceptance of these terms of sale.

8. Prices, payment and billing

Prices are stated in euros, excluding tax (HT) or including tax (TTC) as indicated on the subscription page, with the applicable VAT in force. Payment is made via the means offered on the site (in particular card payment via our payment provider). An invoice is made available for each instalment.

9. Free trial and renewal

Where a free trial is offered, its conditions and duration are specified at subscription. At the end of the trial, the subscription may renew according to the chosen periodicity, unless cancelled before the end of term. The User is informed before any charge.

10. Right of withdrawal

In accordance with Article VI.53, 13° of the Belgian Code of Economic Law, a consumer who requests immediate access to the digital Service acknowledges waiving their right of withdrawal once performance has begun with their prior express consent. Where there is no immediate performance, the consumer has a fourteen (14) day withdrawal period.

11. Termination

The User may cancel their subscription or delete their account at any time from their personal space or by writing to info@espero-soft.com. Deleting the account results in the anonymization or deletion of the associated data, subject to legal retention obligations.

12. Availability and maintenance

The Publisher strives to keep the Service available 24/7 but makes no obligation of result. The Service may be interrupted for maintenance or in the event of force majeure, without the Publisher's liability being engaged.

13. Liability

The Service is provided “as is”. The Publisher cannot be held liable for indirect damages, nor for the use made of the information consulted. In any event, for paid plans, the Publisher's liability is limited to the amount paid by the User over the last twelve (12) months.

14. Intellectual property

The Service, its trademarks, interface and original content are protected by intellectual property law. No transfer of rights is granted to the User, other than a personal, non-exclusive right to use the Service.

15. Personal data

The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.

16. Changes to the Terms

The Publisher may amend these Terms. The applicable version is the one in force at the date of use of the Service or of subscription. Substantial changes are brought to the attention of Users.

17. Governing law and disputes

These Terms are governed by Belgian law. In the event of a dispute, and after an attempt at amicable resolution, the courts of the judicial district of Brussels have sole jurisdiction. Consumers may also use, free of charge, the Belgian Consumer Mediation Service (SPF Économie) or the EU Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
